Presiden ke-7 RI Joko Widodo (Jokowi) merespons putusan Mahkamah Agung (MA) terkait tidak sahnya surat keterangan (suket) penyetaraan ijazah SMA Wakil Presiden Gibran Rakabuming Raka. Jokowi mengatakan, semua pihak harus menghormati proses hukum.

"Ya kita hormati seluruh proses hukum yang ada," kata Jokowi seusai sidang kasus tudingan ijazah palsu di PN Jakarta Timur, Kamis (5/11/2026).

Jokowi meminta semua pihak menghormati konstitusi.

"Juga kita hormati hak-hak yang ada di konstitusi kita. Saya kira itu," jelasnya.

Seperti diketahui, MA mengabulkan kasasi yang diajukan warga bernama Subhan terkait surat keterangan penyetaraan pendidikan SMA dari luar negeri Gibran. MA menyatakan surat keterangan itu tidak sah dan batal demi hukum.

"Kabul kasasi. Batal putusan judex facti. Adili sendiri: kabul gugatan penggugat seluruhnya," demikian putusan nomor 742 K/TUN/2026 seperti dikutip dari situs resmi MA, Jumat (30/10).

Kasasi ini diajukan oleh Subhan terkait gugatannya di PTUN Jakarta dengan nomor perkara 62/G/2026/PTUN.JKT. Tergugat dalam perkara ini ialah Kemendikdasmen. Berikut ini gugatannya di PTUN Jakarta:

1. Mengabulkan Gugatan dari Penggugat untuk seluruhnya.
2. Menyatakan Surat Keterangan Nomor 9149/D.D1/KS/2019, yang diterbitkan di Jakarta pada tanggal 06 Agustus 2019 oleh Direktorat Jenderal Pendidikan Dasar dan Menengah tersebut tidak sah dan batal demi hukum.
3. Memerintahkan agar Surat Keterangan tersebut ditarik dari pihak yang menguasainya untuk dimusnahkan.
4. Menghukum Tergugat untuk membayar biaya perkara.

Gugatan Subhan itu awalnya tidak diterima oleh PTUN Jakarta. Dia kemudian mengajukan banding, tapi PT TUN menguatkan putusan PTUN Jakarta. Setelah itu, dia mengajukan kasasi yang hasilnya ialah gugatan dikabulkan.

Sebagai informasi, Surat Keterangan Nomor 9149/D.D1/KS/2019 itu adalah surat penyetaraan pendidikan tingkat SMA dari luar negeri milik Gibran yang digunakan untuk mendaftar sebagai cawapres pada 2024. Dalam putusan MK, hakim MK menyatakan tidak menemukan bukti ijazah SMA dari luar negeri Gibran yang dijadikan dasar penerbitan surat penyetaraan itu.
